Actor found guilty of lying about attack

As reported by the BBC, actor Jussie Smollett was found guilty by a Chicago jury of lying to police when he claimed he had been the victim of a racist, homophobic assault in January 2019.

The same outlet reports he faced a total of six charges, each referring to separate instances in which he was accused of lying to police. Smollett was found guilty of five of the six charges of disorderly conduct. The actor, 39, had denied all allegations.

In January 2019, Smollett told police he had been the victim of racist and homophobic slurs, with the alleged assailants also dumping a “chemical substance” on him.

A Chicago jury found Smollett guilty on Thursday (10 December) of five counts of disorderly conduct. The BBC reported each count carries a penalty of up to three years in prison.

Nenye Uche, a lawyer for Smollett, said his team “respectfully disagreed with the jury’s verdict” and were “100% confident” the case would be overturned on appeal.

An appeals court came to an agreement with Smollett's lawyers regarding the fact that he should be released pending the appeal of his conviction.

The decision came after he was sentenced to 150 days in jail on March 10, 2022, for the accusations brought against him.

In a 2-1 decision, the appeals court said Smollett can be released after posting a personal recognizance bond of $150,000, according to the Associated Press.

This means Smollett doesn’t have to put down money but agrees to come to court as required.

Appellate Court Justices Thomas Hoffman and Joy Cunningham signed the order granting Smollett’s request to be released, which noted he was convicted of non-violent offenses. Justice Maureen Connors dissented.

Why was Jussie Smollett trending in July 2021?

On July 14, a judge in the renewed case against Smollett met with the actor.

In February 2020, a special Cook County grand jury returned a six-count indictment accusing Smollett of lying to Chicago Police.

Smollett has maintained his innocence to the new indictment, pleading not guilty.

The charges were reinstituted after a special prosecutor was assigned to look into the entire case - after a judge found “unprecedented irregularities” in how Cook County State’s Attorney Kim Foxx handled the case.

FOX News caught up with Smollett moments before entering the courthouse, referring to the proceedings he was about to participate in as a "dog and pony show."

At the time of the alleged beatdown, Smollett, who is Black and gay, told police that two masked men attacked him as he walked home in the early hours of January 29, 2019.

Smollett said the men made racist and homophobic insults, beat him, and looped a noose around his neck before fleeing.

The disgraced actor also insisted that at least one of his attackers was a white man who told him he was in "MAGA country," a reference to former President Donald Trump's campaign slogan, Make America Great Again.

However, brothers Bola and Ola Osundario came forward soon after and told police that the actor had paid them $3,500 to jump him on a Chicago street to raise his profile because he was unhappy with his role on Empire.

The two brothers were associated with the FOX series, which is how Smollett was familiar with them.

The actor has denied Bola and Ola's allegations, claiming the brothers are not telling the truth.

When does the Jussie Smollett trial end?

Smollett's trial began on November 29, 2021.

Judge James Linn said during an October hearing no cameras were allowed in court.

On the same day, attorneys for the actor made a final attempt to have the case dismissed but the judge denied the motion.

The trial wrapped up on Wednesday, December 8, with jury deliberations beginning at around 2.45pm CT.
